NEW PHASE 2 areas (includes GBAR) - NYSAR COVID-19 disclosure form

Good afternoon Members

The NYSAR COVID-19 Disclosure Form has been amended for those regions open under Phase 2 of the reopening plan. The form retains most of its original text with a few minor amendments to reflect the requirements under Phase 2 as well as the inclusion of “landlord/tenant” on the signature line. The form should only be used by licensees practicing in those regions currently open under Phase 2. For those areas still under Phase 1, the original form should be used.

The Phase 2 form is presented and filled out in the same manner as the original “COVID-19 Disclosure Form”.

Local boards/MLS/brokers are prohibited from modifying the form in any way except to add their name and/or logo to the “co-branding area”. Through this email communication, NYSAR is sending the form out to all local board/MLS EO’s today.

As always, licensees should check with their broker before using any forms.

Attached is a NEW Phase 2 COVID-19 disclosure, developed by NYSAR, that our members may use to provide to a seller or buyer only after direction from his or her Broker. This disclosure confirms that the parties acknowledge that there are risks associated with the transmission of COVID-19 and they are assuming such risk if the seller permits individuals to enter a property or if individuals enter a property.

The form can be presented to the seller and/or buyer by the Realtor ONCE and without the need to have a new form filled out for every potential transaction, much like the agency disclosure form.
