On behalf of NYSAR, our thoughts and prayers go out to those who have lost so much during the recent storm. For those affected, we hope that soon you will be back in your homes and offices and that you receive the support you need to put your lives back together after the devastation you’ve experienced.
For our members interested in, or registered to attend, Triple Play in Atlantic City, NJ, December 4-6, we want to let you know that there are no plans to cancel the convention. All of the convention headquarter's hotels are up and running and the convention center, which is currently is being used as a temporary shelter, comfort station and distribution center for food, water, and ice, will be ready to host our event in December. The shops and most restaurants have reopened and it appears that the damage was limited to certain areas of the city, as well as the bridges heading south.
As usual, we will be accepting donations on-site for the Atlantic City Rescue Mission, which undoubtedly is overburdened at this time. We look forward to seeing you next month, in Atlantic City, if your plans allow.

Description: This 2 CE session will provide the latest information for New York licensed brokers, managers, and agents. NYSAR’s Legal Counsel, Anthony Gatto, Esq., will cover a wide array of legal issues including legal obligations of the licensee and an in-depth look at agency as well as other issues critical to reducing risk in your real estate practice.

Objectives
Upon completion, participants will be able to:
• List and discuss the legal obligations of a real estate licensee including license law, regulations, common law of agency, and tort law. • Discuss the principles of agency, how it is established and what the fiduciary duties entail. • List the types of agency options a licensee may engage in and explain the duties and applications of each. • List and explain the penalties for breach of fiduciary duty. • Define, contrast and compare express agency and implied agency. • Describe the regulatory and statutory requirements for licensees as they pertain to agency and agency disclosure. • Define a real estate “team” and discuss what a team may and may not do under law. • Distinguish between agency relationships a team can and cannot enter into. • Discuss why only a broker can be responsible for their branch offices and agreements. • List the tasks that an unlicensed personal assistant may and may not do under NYS License Law. • Outline NYS and Federal Laws pertaining to the advertising of real property including sign contents, property descriptions, licensees, license types, and the use of nicknames, team names and logos. • Describe state and federal regulations as they pertain to print advertising as well as Internet-based advertising and social media. • List what information should be included on a business card, sign and advertisement. • Discuss the issues associated with advertising the listing of another broker.
