Grievance and Professional Standards Committee Purpose & Responsibilities

PURPOSE:  The purpose of the Grievance Committee is to evaluate ethical and arbitration complaints presented to the 
Association and determine whether the complaint warrants a hearing by the Professional Standards Committee.

MEMBERSHIP:  Membership is open to GBAR REALTOR® members (minimum 6).

Note:  A member of the Grievance Committee should not be on the Professional Standards Committee or on the 
Board of Directors.

RESPONSIBILITIES

  • To review complaints (Public and REALTOR®) presented to the Association.
  • To assist, if needed, the complainant in the process of filing a complaint.
  • To forward appropriate complaints to the Professional Standards Committee.
  • For all committee members to attend training seminars (see subsection 1 below)
  • For filling complaints if the need arises and provide determinations of the panel to the Executive Officer with 
    instructions to dismiss or refer to the Professional Standards Committee.
  • To follow procedures set forth in the Code of Ethics and Arbitration Manual.

REPORTS TO:  Board of Directors

Subsection 1   Grievance & Professional Standards Committee Members (BOD approved November 17, 2006 )

In order to review an ethics complaint (Grievance Committee) or sit on a hearing panel (Professional Standards 
Committee) GBAR members of those respective committees must have attended the NYSAR PSC Training within 
the last two years.

Section 17  PROFESSIONAL STANDARDS COMMITTEE  (BOD approved 12/21/05
                   (Standing Committee)

 

PURPOSE:  The purpose of the Professional Standards Committee is to conduct hearings as required on matters of 
unethical conduct of Association Members or arbitration as requested.

MEMBERSHIP:  Membership is open to GBAR REALTOR® members (minimum 12) who have completed the Professional 
Standards training.

RESPONSIBILITIES

  • To conduct ethical or arbitration hearings brought forth from the Grievance Committee.
  •  
  • Provide information and assistance regarding the understanding of the Code of Ethics and enforcement of professional standards and arbitration matters.
  • To have reciprocal hearing agreements with Boards/Associations.
  • Encourage committee Members and Directors to attend on going Professional Standards training (see subsection 2 below).
  •  
  • To provide mediation when necessary with individuals (local or outside mediators) who have completed appropriate training.
  • To follow procedures set forth in the Code of Ethics and Arbitration Manual.
