AFFIRMATION REQUEST: PRESENTATION OF PURCHASE OFFER PURSUANT TO STANDARD OF PRACTICE 1-7

As you know, NAR amended Standard of Practice (SoP) 1-7 requiring a listing broker, upon request of the cooperating broker, to provide an affirmation acknowledging presentation of an offer to the Seller. The attached form meets the requirements of SoP 1-7. NYSAR consulted with NAR as to what could be included on the form and whether a specific time period could be included for the return of the affirmation (For example - This affirmation must be returned within 3 business days of the presentation of the offer to the Seller). NAR responded that there can be no specific time requirement (as this would be beyond the scope of SoP 1-7) other than “as soon as practical” which was approved at the NAR meetings a few weeks ago.

The purpose of the form is only to show compliance with SoP 1-7. Furthermore, nothing within SoP 1-7 requires the Seller to sign the form, only the listing broker (or their associated licensees) which is why there is no line for a Seller’s signature.

If the form is ignored and not returned or is signed without truly presenting offer, it should be considered a serious Ethics violation punishable by a higher penalty.
