Important Message from Jon Sarra, GBAR Legal Counsel: As you know, the City of Binghamton has traditionally issued separate letters for zoning and code compliance depending on the request. Our residential and commercial contract allows for a buyer to elect one or both of these separate inspections and make the contract contingent upon receipt of an acceptable letter. It came to my attention that the former Code Compliance Certificate is now titled Certificate of Occupancy. In talking with the appropriate officials at the City, nothing has changed except the title of the document. For years, the City has heard from REALTORS® and mortgage lenders that a Buyer requires a Certificate of Occupancy for some purpose or another. Consequently, and for other reasons, the City decided to change the title of the document. There are no other changes to process and this document is NOT required to sell or own property in the City of Binghamton. The zoning compliance letter has not changed and remains a separate request.
